Terms and Conditions for Jobs4travellers.com.au Members
These Terms and Conditions apply to any individual who registers a user account ("the Registered Member") in order to use the website located at www.Jobs4travellers.com.au/ .com ("the Site") as administered by, owned and operated by 4TRAVELLERS Ltd (Registered in England and Wales - company no 8102432) for the purposes of seeking gainful employment.
The Registered Member acknowledges that they have read and understood the Terms and Conditions prior to registering their user account, and further agrees to be bound by the Terms and Conditions when using the Site and its Services.
- Services
- Jobs4travellers.com.au provides online recruitment advertising services ("Services") to prospective employees and employers, dealing exclusively with employment opportunities attracting and suitable for persons on the Australian working holiday visa or Student visa scheme.
- Registered member
- The Registered Member hereby agrees to use the Site for the sole purpose of securing his or her employment.
- The Registered Member confirms that their Resume / Curriculum Vitae and other information uploaded to the Site are a true and accurate reflection of the Registered Member's education, employment history and training, and that all personal details are correct and properly attributable to the Registered Member.
- The Registered Member confirms that they posses the legal right to work in Australia and are in possession of a valid visa which includes work rights.
- The Registered Member authorises Jobs4travellers.com.au to verify that the information uploaded to the Site, including but not limited to personal details, education, employment history and training and salary are true and accurate.
- The Registered Member will be responsible for notifying Jobs4travellers.com.au of any change in their contact details, including email address and telephone number.
- Any change in the Registered Member's employment status will be communicated to Jobs4travellers.com.au by the Registered Member within fourteen (14) days of that change.
- The Registered Member confirms that he or she has the right to work legally in the country he or she has applied for employment.
- General use of the site
- Jobs4travellers.com.au limits each Registered Member to one user account. The Registered Member agrees that it will not register more than one user account for use with the Site and its Services, or register an account on behalf of any other person, group or entity.
- The Registered Member agrees to maintain confidentiality in all login and password details for their user account, and will not disclose to a third party or otherwise misuse those details.
- The Registered Member must not use screen scraping, data mining, robots or other automated scripts for the purpose of collecting information from, or otherwise interacting with, the Site.
- Access and use of this Site is limited, non-transferable and allows for the sole use of the Site by the Registered Member for personal, non-commercial purposes only for the duration of the membership. The Site may not be used in connection with any commercial endeavours such as commercial recruitment gain, except those that are specifically endorsed or approved by the management of jobs4travellers. Commercial advertisements, affiliate links, and other forms of client solicitation may be removed from Registered Members' profiles without notice and may result in the termination of membership privileges. Appropriate legal action will be taken by Jobs4travellers.com.au for any illegal or unauthorised use of the Site.
- The Registered Member will not use the Site in a manner contrary to these Terms and Conditions, the laws of NSW, or in any other manner that may damage, disable, over-burden or impair the Site.
- Uploading documents
- The Registered Member must not upload, transmit, share, store or otherwise make available any material to the Site in which they do not own copyright within the meaning of the Copyright Act 1968 (Cth), including but not limited to original artwork and video stream.
- The Registered Member must not use the Site to upload, transmit or facilitate the transmission of one or more unsolicited electronic messages with an Australian link ("Spam") pursuant to the Spam Act 2003 and the Spam Regulations 2004, including without limitation:
- unsolicited or unauthorised advertising;
- unsolicited promotional materials;
- chain letters;
- material related to pyramid or other sales schemes.
- The Registered Member warrants that all materials it uploads, transmits, stores, posts or otherwise makes available on the Site will be free of any software virus, spyware or any other application that may cause damage to the Site, its Services or material belonging to other Registered Members.
- The Registered Member must not upload, transmit, store, post or otherwise make available on the Site personal information belonging or attributable to any third party pursuant to the Privacy Act 1988, including without limitation residential addresses, residential phone numbers, personal email addresses and credit card numbers.
- The Registered Member must not upload, transmit, store, post or otherwise make available on the Site any content that Jobs4travellers.com.au deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful or racially, ethnically or otherwise objectionable under any Commonwealth or State legislation.
- Liability
- Jobs4travellers.com.au will not be liable for any failure by the Registered Member to secure employment, or any consequential loss flowing from that failure, due to any act or omission on the part of the Registered Member, Jobs4travellers.com.au or its partners, directors, employees or agents.
- Jobs4travellers.com.au will take reasonable steps to ensure the privacy and integrity of information provided by the Registered Member pursuant to the Privacy Act 1988.
- Jobs4travellers.com.au disclaims all liability to the maximum extent permitted by law for any loss or damage beyond the reasonable control of jobs4travellers, or arising from any act or omission of the Registered Member, including without limitation loss or damage resulting from:
- hardware failure;
- provision or use of software;
- virus, worm, spyware, automated script or other unauthorised application capable of corrupting or otherwise altering data;
- deletion, corruption, loss or removal of data;
- breach of security in, or unauthorised access to, a Registered Member's user account arising from the Registered Member's misuse of login and password details, or disclosure of login and password details to a third party.
- While Advertisers are required to adhere to the Client Terms and Conditions, Jobs4travellers.com.au will not be liable for the accuracy of any advertisement or availability of any specific job advertised on the Site.
- Jobs4travellers.com.au.au does not accept any liability or responsibility for the content of any advertisements appearing on the Site. No obligations are placed on Jobs4travellers.com.au in this regard, and resolution of any disputes arising between the Registered Member and third party advertisers will be the sole responsibility of the Registered Member.
- Jobs4travellers.com.au provides links from the Site to websites maintained by third parties. Jobs4travellers.com.au does not accept any liability or responsibility for the content of any third party websites, including without limitation the accuracy or legality of the content and any guarantees or endorsements appearing in that content.
- Jobs4travellers.com.au gives no guarantee as to the availability and performance of the Site. Accordingly, the Site is provided by Jobs4travellers.com.au on an "as and when available" basis.
- To the maximum extent permitted by law, the Registered Member agrees to limit the liability of Jobs4travellers.com.au for breach of these Terms and Conditions or any other law or legislation to having the Services supplied again.
- Indemnity
- The Registered Member agrees to indemnify Jobs4travellers.com.au and its partners, directors, employees and agents against all claims, demands, proceedings and other liability arising wholly or partly, directly or indirectly, from using the Site.
- Without limiting the generality of clause 6.1, the Registered Member indemnifies Jobs4travellers.com.au and its partners, directors, employees and agents against any costs, expenses, losses, damages, liability and claims suffered or incurred and arising from the Registered Member's breach of these Terms and Conditions any negligent or unlawful act or omission by the Registered Member in connection with the Site.
- Right of refusal
- Jobs4travellers.com.au reserves the right to refuse, withdraw or require the amendment of material uploaded to the Site that Jobs4travellers.com.au deems unlawful, immoral, defamatory, obscene, offensive, fraudulent, discriminatory based on race, sex or ethnicity, or otherwise objectionable.
- Jobs4travellers.com.au reserves the right to refuse membership to any person providing false information to the Site.
- Termination of registered member user account
- The Terms and Conditions will continue to apply until terminated by either the Registered Members or by Jobs4travellers.com.au as set out below.
- Registered Members may upon written application to Jobs4travellers.com.au request Jobs4travellers.com.auto terminate their user account.
- Jobs4travellers.com.au will verify the request referred to in clause 8.2 before terminating the Registered Member's user account.
- Upon receiving written verification regarding their request for termination, Jobs4travellers.com.au may notify a Registered Member by way of email that their user account has been terminated.
- Jobs4travellers.com.au may from time to time, terminate its legal agreement with Registered Members if:
- a Registered Member has breached any provision of the Terms and Conditions or intend to breach any provision; or
- Jobs4travellers.com.au is required to do so by law; or
- Jobs4travellers.com.au is transitioning to no longer providing the services to Registered Members; or
- the provision of the services to Registered Members by Jobs4travellers.com.au, is in Jobs4travellers.com.au ‘s opinion, no longer commercially viable.
- On termination, a Registered Member will no longer have access to the user account.
- On termination, a Registered Member will continue to be bound by all Terms and Conditions capable of surviving termination.
- On termination no refund will be given for unused services or memberships
- Dispute resolution
- Any dispute under or arising out of this agreement shall be referred to arbitration by a single arbitrator. The arbitration shall be conducted in accordance with the rules for the Conduct of Commercial Arbitration of the Institute of Arbitrators and Mediators Australia ('IAMA') and subject to those rules, in accordance with the provisions of the Commercial Arbitration Act 1984 of Victoria.
- The parties agree and accept that the determination of the arbitration is final and binding.
- Intellectual property
- All intellectual property appearing on the Site ("Intellectual Property") are owned by jobs4travellers.com.au, unless otherwise indicated. In using the Site, the Registered Member agrees not to infringe any Intellectual Property owned by Jobs4travellers.com.au or any third party.
- All intellectual property uploaded by the Registered Member to the Site constitutes an assignment of the intellectual property from the Registered Member to jobs4travellers.com.au.
- Updates and changes to the site
- Jobs4travellers.com.au may update, alter, discontinue or create any feature of the Site at its absolute discretion.
- Privacy policy
- The Registered Member acknowledges that it has read and understood the Privacy Policy prior to registering for a user account.
- Amendments to terms and conditions
- Jobs4travellers.com.au may vary these Terms and Conditions from time to time at its absolute discretion.
- The Registered Member's continuing use of the Site and the Services of Jobs4travellers.com.auconstitute the Registered Member's agreement to these Terms and Conditions and any modification to them. The Registered Member agrees to review these Terms and Conditions regularly.
- If a material change to the Terms and Conditions is made, Jobs4travellers.com.au will notify the Registered Member by placing a prominent notice on the Site identifying the change, or by notifying the Registered Member of the change via email.
- Severance
- If any part of this agreement is found to be invalid or of no force or effect under any applicable laws, executive orders or regulations of any government authority having jurisdiction, this agreement shall be construed as though such part had not been inserted herein and the remainder of this agreement shall retain its full force and effect.
- Governing law
- These Terms and Conditions are governed by the laws of the State of New South Wales (Australia). If any part these Terms and Conditions is found to be invalid or unenforceable, it shall be severed to the extent possible without affecting the remainder.
- This agreement and any dispute, controversy, proceeding or claim of whatever nature arising out of, or in any way, relating to this agreement and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of NSW, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. This agreement shall be binding to the benefit of the parties hereto and their successors and assigns.
- Both parties confirm and declare that the provisions of this agreement are fair and reasonable and both parties having taken independent legal advice and declare this agreement is not against public policy on the grounds of inequality or bargaining power or general grounds of restraint of trade.
Advertiser Terms and Conditions
These terms and conditions ("the Agreement") apply to any party ("the Advertiser") wishing to engage 4TRAVELLERS Ltd (UK Compny no 0810 2432) owner and operator of the site ("www.Jobs4travellers.com.au") for the provision of online recruitment advertising services ("the Services") through their website at www.jobs4travellers.com.au ("the Site"). Please read these Terms and Conditions carefully before accessing or using the information and services available through the Site. By accessing or using the Site, the Advertiser agrees that it has read, understood and agrees to be bound by Jobs4 travellers.com.au Terms & Conditions.
- Services
- Jobs4travellers.com.au provides the Services to employers or representatives of employers seeking to fill employment positions attracting and suitable for persons on the Australian working holiday Visa and student visas.
- Advertisements will become live on the Site only when the Jobs4travellers.com.au has approved all information, design work, set-up, artwork and logos.
- Advertisements are posted for a minimum of 30 calendar days. Notwithstanding this, the Advertiser and Jobs4travellers.com.au may agree in writing to shorten or lengthen this period.
- Jobs4travellers.com.au reserves the right to remove any multi-job listing that appears within the same employment advertisement.
- Links to the Advertiser's website or websites associated with the Advertiser and contact details will not be permitted to appear in any advertisement placed without jobs4travellers.com.au prior consent, however, Jobs4travellers.com.au reserves the right to remove such links and information at its absolute discretion.
- Jobs4travellers.com.au shall be entitled at any time without notifying the Advertiser, to make changes to advertisements which are necessary to comply with any applicable security or statutory requirements and shall determine, at its absolute discretion, the manner in which the changes are applied.
- Setting up an account
- The Advertiser is required to register and create an account with Jobs4travellers.com.au if the Advertiser wishes to engage the Services of jobs4travellers.com.au.
- Quotation
- The quotation for advertising rates and other fees charged are to be agreed to by Jobs4travellers.com.au and the Advertiser in writing prior to the advertisement being displayed on the Site or prior to the provision of Services.
- All rates are in Australian dollars and exclude GST.
- Payment
- Jobs4travellers.com.au will provide the Advertiser with an invoice stating jobs4travellers.com.au fees in relation to the Services provided to the Advertiser.
- The fee for any online recruitment advertising service provided by Jobs4travellers.com.au must be paid within 7 calendar days of the invoice being issued, unless other terms of payment have specifically been agreed to by Jobs4travellers.com.au in writing.
- If the Advertiser fails to make any payment by the due date referred to in clause 4.2, all moneys owing by the Advertiser to Jobs4travellers.com.au shall immediately become due and payable and the provisions of clause 4.4 shall forthwith apply to such moneys.
- Jobs4travellers.com.au reserves the right to charge interest on any overdue invoice at the rate of 18% per annum, calculated daily on a compounding basis for each day that such invoice remains overdue.
- If the Advertiser submits payment by using a credit card and that payment is unable to be made for whatever reason, the Advertiser agrees that they will be liable for all charges and costs associated with resubmitting a request for payment.
- The Advertiser may remove an advertisement from the Site before the advertisement has reached its expiry date but the Advertiser shall not be entitled to a refund for the time not used.
- The Advertiser shall be required to pay the invoiced amount in full for the agreed advertising period, notwithstanding any unused Services remaining at the expiry of that period. Unused Services may not be carried over to any subsequent advertising period.
- Jobs4travellers.com.au obligation
- Jobs4travellers.com.au will use its reasonable endeavors to enable Registered Members the facility for viewing the Advertiser's advertisement on the Site.
- Jobs4travellers.com.au will use its reasonable endeavors to publish the Advertiser's advertisement or provide other agreed online recruitment advertising Services to the Advertiser by the agreed date.
- Advertiser's obligations
- The Advertiser hereby undertakes and warrants to Jobs4travellers:
- that the Advertiser will use all reasonable precautions against access to the Site by any unauthorised persons, including but not limited to the use of user names and passwords and the securing of information relating to communications between the Advertiser and the rest of the Site;
- to respond to all applications from Registered Members;
- that the Advertiser will not use any information obtained from any Registered Member for the purpose other than the assessment of the person's suitability for the role being advertised;
- that any information supplied by the Advertiser is accurate, complete and true;
- that the Advertiser owns the copyright in or has authorisation from the copyright owner to upload, post, transmit, share, store or otherwise make available to Jobs4travellers.com.aufor use on the Site any advertisement which contains a name, pictorial representation or video;
- that the Advertiser will not perform any refresh or reposting of advertisements purely for the purpose of restoring the Advertiser's advertisements to the top of any search listing;
- that the Advertiser will keep the status of the Advertiser's advertised job position up-to-date and inform all job applicants of their acceptance or rejection at each stage of the application process;
- that material uploaded, posted, transmitted, shared or otherwise made available to the Site is free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties;
- that each advertisement is legal, decent, honest and truthful and complies with all applicable laws, rules, regulations and codes relating to advertising as may be appropriate;
- that no advertisement contains any data, image or other material which;
- (a) is offensive, obscene or indecent, or capable of being resolved into obscene or indecent images or material;
- (b) is defamatory, threatening or racially, ethnically or otherwise objectionable;
- (c) is designed or likely to cause annoyance, inconvenience, unwanted attention or needless anxiety to any other person;
- (d) infringes the rights (including, without limitation, the intellectual property rights) of another person;
- (e) is designed or likely to cause disruption to any computer system or to any network; or
- (f) is illegal or designed or likely to induce an illegal act.
- The Advertiser agrees to provide jobs4travellers.com.au, in such a format as Jobs4travellers.com.aumay request, any information, design work, artwork and logos necessary to enable Jobs4travellers.com.au to provide the Services.
- Unless agreed otherwise, the Advertiser will only include branding on the Site where the Advertiser has consented to such branding appearing.
- The Advertiser will obtain the express consent of a Registered Member prior to submitting, copying, supplying, re-selling, distributing or making available his or her resume / CV to any third party.
- The Advertiser hereby undertakes and warrants to Jobs4travellers:
- Error or delay
- Jobs4travellers.com.au does not accept liability for any consequences, howsoever arising, due to error or delay in the Service and has the right at its absolute discretion to decline to publish or omit, suspend or change the position of any advertisement accepted by it.
- Right of refusal
- Jobs4travellers.com.au reserves the absolute right, without giving any reasons, to decline, cancel or remove any advertisement or provision of the Services for any reason and at any time without prior notice.
- Reporting illegal content
- Jobs4travellers.com.au may, at its absolute discretion and without prior notice, report to the relevant authorities any advertisement or online recruitment advertising service used, which in its reasonable opinion is being used for an improper or illegal purpose by the Advertiser.
- Intellectual property
- All intellectual property rights (including future copyright) in the formation and other material appearing on the Site vests in and is the exclusive property of Jobs4travellers.com.au, its assigns and licensors. The Advertiser may not and must not allow or permit other parties whether or not on the Advertiser's behalf, to copy advertisements or other similar activities unless the Advertiser have obtained the prior, written permission of jobs4travellers.com.au
- All intellectual property uploaded by the Advertiser to the Site constitutes an assignment of the intellectual property from the Advertiser to jobs4travellers.com.au.
- Confidentiality
- Jobs4travellers.com.au retains all property rights in all information and all other knowledge relating to Jobs4travellers.com.au, the Services including the technology and design of the services, the way the Services are implemented, the personnel, policies and business strategies of Jobs4travellers.com.au and the terms of the agreement (including pricing) which come into the Advertiser's possession from any source, or information which is treated by Jobs4travellers.com.au as confidential regardless of its form, or which is designated by its nature as confidential, but excluding information in the public domain or which may be obtained from Jobs4travellers.com.au without restriction ("Confidential Information").
- The Advertiser will not use Confidential Information which the Advertiser acquires from Jobs4travellers.com.au for any purpose which may cause Jobs4travellers.com.au loss, whether by way of damage to Jobs4travellers.com.au reputation, financial loss, or otherwise.
- The Advertiser will keep confidential the resumes / CVs and all other information supplied by Jobs4travellers.com.au or Registered Members to the Advertiser or the Advertiser's employees or agents.
- Liability
- While Jobs4travellers.com.au will attempt to verify a Registered Member's details, it does not guarantee the truth or accuracy of such details. Jobs4travellers.com.au accepts no responsibility or liability as to the suitability of Registered Members who respond to advertisements.
- Jobs4travellers.com.au disclaims all liability to the maximum extent permitted by law for liability of any description, including liability for negligence (except for personal injury or death), or any damages or losses (including, but without limitation to indirect or consequential loss, or loss of business, revenue, profits, use or opportunity) howsoever resulting from the Advertiser's use of (or inability to use) the Site.
- Jobs4travellers.com.au does not accept liability, of any description, however arising, for any loss or damage caused to the Advertiser, or any other third party, arising from any virus or other impairing computer program contained in any CV, resume or other documents submitted by any Registered Member.
- Jobs4travellers.com.au does not accept liability for:
- any loss of copy, artwork, photographs, data or other materials that the Advertiser supplies to jobs4travellers.com.au ; or
- any mistakes or errors whatsoever that arise during the course of publication of any advertisement or any loss of information or data or any damage thereto in each case as a result of circumstances beyond its reasonable control or which arise as a result of the acts or omissions of the Advertiser.
- To the maximum extent permitted by law, the Advertiser agrees to limit the liability of Jobs4travellers.com.au for breach of these Terms and Conditions or any other law or legislation to having the Services supplied again.
- Warranties
- All warranties, conditions and representations whether express or implied (other than express warranties stated by Jobs4travellers.com.au in writing) are excluded except in circumstances whereby Jobs4travellers.com.au is by law unable to exclude or limit liability.
- Jobs4travellers.com.au makes no warranty that the Site (or any website that is, or may become linked to this website) is free from computer viruses, "cookies", or any other malicious or impairing computer programs and/or that the Site shall operate uninterrupted and error-free.
- Jobs4travellers.com.au does not warrant that any advertisement placed on the Site will attract applications from its Registered Members, or that any advertisement placed on the Site will lead to the placement of a successful candidate in the advertised position.
- Without limiting the generality of the above, the Advertiser warrants that nothing in the material lodged for publication on the Site breaches any laws in any State or Territory of Australia and the Commonwealth of Australia.
- Relevant law
- These Terms and Conditions are governed by, and must be construed in accordance with the laws of the State of News South Wales.
- Indemnity
- The Advertiser agrees to indemnify Jobs4travellers.com.au and its partners, directors, employees and agents against all claims, demands, proceedings and other liability arising wholly or partly, directly or indirectly, for using the Site.
- The Advertiser indemnifies Jobs4travellers.com.au in respect of any claim, action, damage, loss, liability, cost, charge, expense, outgoing or payment suffered or incurred by Jobs4travellers.com.au(including, but not limited to, economic loss and all legal costs and disbursements on a full indemnity basis) caused by the Advertiser and/or any wilful, illegal or negligent act or omission by the Advertiser.
- Termination
- Jobs4travellers.com.au may cancel any advertisement, terminate any agreement, or commence legal proceedings against the Advertiser to recover any overdue amount including legal costs in relation to any action taken against the Advertiser by jobs4travellers.com.au, if:
- the Advertiser fails to pay for any premium online recruitment advertising Services provided by jobs4travellers.com.au, in accordance with any agreement between the Advertiser and Jobs4travellers.com.au and these Terms and Conditions;
- the Advertiser breaches the Terms and Condition of this Agreement;
- the Advertiser commits an act of bankruptcy;
- the Advertiser becomes insolvent;
- the Advertiser, in the opinion of jobs4travellers.com.au, is in breach of any law or regulation;
- a receiver, administrator, liquidator or manager is appointed over any of the Advertiser’s assets; or
- if the Advertiser resolves to wind up the Advertiser's company.
- Jobs4travellers.com.au may cancel any advertisement, terminate any agreement, or commence legal proceedings against the Advertiser to recover any overdue amount including legal costs in relation to any action taken against the Advertiser by jobs4travellers.com.au, if:
- Dispute resolution
- Any dispute under or arising out of this agreement shall be referred to arbitration by a single arbitrator. The arbitration shall be conducted in accordance with the rules for the Conduct of Commercial Arbitration of the Institute of Arbitrators and Mediators Australia ('IAMA') and subject to those rules, in accordance with the provisions of the Commercial Arbitration Act 1984.
- The parties agree and accept that the determination of the arbitration is final and binding.
- Compliance with foreign law
- Jobs4travellers.com.au makes no representation that the content of the Site complies with the law of any country outside Australia. If the Advertiser accesses this Site from outside Australia, the Advertiser is responsible for ensuring that the Advertiser complies with all laws in the place where the Advertiser is located.
- Amendments
- Jobs4travellers.com.au may vary these Terms and Conditions from time to time at its absolute discretion.
- If a material change to the Terms and Conditions is made, Jobs4travellers.com.au will notify the Advertiser by placing a prominent notice on the Site identifying the change, or by notifying the Advertiser of the change via email.
- Privacy policy
- The Advertiser confirms that the Advertiser has read, understood and agrees to be bound by Jobs4travellers.com.au Privacy Policy.
- Suspension
- Jobs4travellers.com.au reserves the right to suspend or close the Advertiser's account at its absolute discretion in the event of, but not limited to the events referred to in clause 16 or breaches of these Terms and Conditions.
- Severance
- If any provision of these Terms and Conditions is held unenforceable in whole or in part, these Terms and Conditions shall continue to be valid as to the other provisions and the remainder of the affected provision.
